Introduction
Legislation relating to Elevator Safety in Missouri was
enacted in 1994 . Statutory enforcement responsibility was placed under the
Department of Public Safety and assigned to the Division of Fire Safety.
Promulgated rules and regulations developed by the Governor
appointed Elevator Safety Board became effective in July of 1999. The purpose of
these rules and regulations is to assist with administering the program.
In summary, the Elevator Safety Rules and Regulations
require that each elevator and related equipment within the scope of the statute must be
registered, inspected, and tested on an annual basis by a Missouri State Licensed
Inspector.
Within twelve months after the adoption of promulgated
rules and regulations all existing and new installations of elevators and related
equipment, i.e. escalators, dumbwaiters, freight elevators and moving walkways, must be
registered with the Division of Fire Safety. Registration must be submitted on forms
provided by the Division. Failure to register with the Division may result in a
penalty being assessed as prescribed by law.

Registration will include type of unit, contract load and
speed, name of manufacturer, location and purpose for which it is used. Registration

Inspections
The owner, operator, lessee or agent of either is responsible
for obtaining an annual safety inspection and a load test witnessed by a state licensed
elevator inspector. The inspector must be certified by the Elevator Safety Board
and possess QEI Certification or approved equivalency. To become QEI certified you
must successfully pass a written examination administered by an association accredited by
the American Society of Mechanical Engineers or other nationally recognized certification
entity. All existing inspectors shall have one year from the effective date of
promulgated rules and regulations to meet this qualification.
Upon receipt of an approved safety inspection and test, the
law requires that a state-operating certificate be issued for that installation. No
elevator or related equipment shall operate in Missouri without having obtained a
state-operating certificate. Violation of this section may result in misdemeanor
criminal charges.

New Installations & Alterations
The Elevator Safety Act also requires the
Missouri Division of Fire Safety to issue an installation or alteration permit upon review
and approval of plans for new installations or alterations. Effective January 1,
2003, all plan reviews for new installations of elevators and modernization of existing
elevators will be conducted by the Elevator Safety Unit. Please submit all plans to

Exceptions to the plan review process are those units
located in municipalities contracting with St. Louis county and Kansas City.
Existing Installations
A political sub-division or municipality that
had adopted an edition of the A17.1 code: annual inspections and tests shall be
performed to the code adopted and enforced at the time the elevator was installed.
The Missouri minimum standard set forth in CSR 40-5.065 will be applied to all existing
elevators that were installed in areas that did not have an edition of the A17.1 code
adopted at the time of their installation. Existing elevators are elevators that
were installed prior to July 1, 1999.

More Information
The Elevator Safety Act does not preclude
municipalities or local governmental entities, which have an existing local ordinance or
law, which meets or exceeds state requirements. However, a state operating
certificate is still required and will be issued upon receipt of an approved inspection by
an approved local entity.

The Elevator Safety Unit is allocated a Deputy Chief, five
State Inspectors, a Senior Office Support Assistant and an Office Support Assistant.
Fee Schedule for inspections conducted by a State employed
inspector with the Division of Fire Safety is as follows:
- Annual Inspection: $125.00 per unit, PLUS expenses
- State Operating Certificate fee - $25.00 per unit
