| During the 2001 legislative session
Senate Bill 197, sponsored by Senator Sidney Johnson, was passed by the General Assembly
and signed by Governor Holden on June 2, 2001. Senator Johnson was not alone, this topic
was quite popular during this years session. Many legislators from both parties also
filed similar bills supporting civil immunity to donors of such equipment. The law, created by Senate Bill 197, became effective August 28, 2001 and provides civil immunity to any fire protection district, volunteer fire protection association or any fire department of any political subdivision which donates equipment used to suppress fire or fire protective clothing to another department if certain conditions are met. With this law, use of trash dumpsters can be eliminated as being used for the drop off point for donated equipment as we have heard was all too common. Departments desiring to donate equipment to specific departments need to download a copy of the Donated Equipment application by selecting the link above and submit it along with any necessary documentation to the Division of Fire Safety for approval.
