94th General Assembly Enacts Tax Credits for Dry Fire Hydrants


 
In the 94th General Assembly, tax credits for the installation of dry hydrants was again enacted.  This legislation allows for a tax credit of 50% of the costs associated with the installation of a dry fire hydrant, up to $5,000.00 to be allowed to any individual installing an approved dry hydrant.  This credit is available until August 29, 2010, or until the tax credit cap ($500,000.00) has been exceeded.

The process to apply for this tax credit is outlined below.

     1)   A pre-application form is obtained from either this web site or through
            the Division of Fire Safety.
     2)   The pre-application form is completed by the taxpayer.
     3)   The proposed location of the dry hydrant is apporved by the local fire
            service authority, who then signs off on the pre-application form.
     4)   The pre-application form is forwarded to the State Fire Marshal's
            Office for review.   After review, the pre-application form is sent to the
            Department of Economic Development.
     5)   The Department of Economic Development will then send the taxpayer
            a Dry Hydrant Tax Credit Claim form.
               a.    The Tax Credit Claim form has a section for the local fire service
                      authority to approve the installation and location of the finished
                      hydrant.
              b.    The form is notarized and then returned to the Department of
                     Economic Development along with all documentation of costs
                     associated with installation of the approved dry hydrant.

     6)   The Department of Economic Development approves the tax credit
            and forwards the information to the Department of Revenue.

The dry hydrant should be installed to substantially meet the National Resources Conservation Dry Hydrant Standard.

The installation of a Dry Hydrant is meant to be a cooperative effort between landowners and their local fire service agency to provide safe and efficient fire controls as well as enhance rural development.
