Effective January 1, 2005
During the 2004 legislative session, House Bill 1403 passed, and in August 2004 was signed by Governor Bob Holden.  The following  information summarizes key components of the changes which become effective January 1, 2005.

Definition of "amusement ride" has been amended to now require the following to meet the annual safety inspection process to obtain a state operating permit.

  • Any dry slide over twenty feet (20');
  • Any tram, open car, or combination of open cars or wagons pulled by a tractor or other motorized device, except hayrack rides and those devices that are used solely to transport patrons to and from parking areas or those used for guided or educational tours;
  • Any bungee cord attraction or similar elastic device;
  • Any climbing wall over ten feet (10') in height except for not-for-profit entities that follow the YMCA Services Corporation's Climbing Wall Safety Guidelines or the Boy Scouts of America Guidelines.

Missouri Division of Fire Safety now may conduct "spot" safety inspections of any amusement ride operating in Missouri.  Non-compliance life safety issues noted during a spot inspection will result in a temporary suspension of the ride's state operating permit.  The ride will be required to be re-inspected by a Division of Fire Safety Inspector to ensure the ride is in compliance.

Each amusement ride owner/company shall file an itinerary (available here) with the Division of Fire Safety no less than fifteen (15) days before event dates.  The itinerary must contain the following information:

  • Name of amusement ride owner;
  • Name of carnival, fair, or activity sponsor;
  • Address and telephone number of the site or event sponsor;
  • Event date(s) open to the public;
  • Date of setup;
  • Name of contact person on site.
